Who must apply for a residence permit?

How do you apply?

• The application for a residence permit is submitted to the competent Police Headquarters , often via postal kit or appointment.
• You must submit documents such as your passport, visa (if applicable), photo, electronic permit, and specific documentation for the type of permit requested, such as an employment contract, school enrollment, or family-related documentation.
• The length of a residence permit varies depending on the reasons and type of permit; for example, for work-related reasons, it may be tied to the length of the contract.
• The electronic residence permit is issued on average 60 days after the application is submitted.

Types of residence permits:There are different types of residence permits, including:

• Work: Subordinate, self-employed, seasonal.
• Study: For study or training purposes.
• Family reasons: Family reunification, adoption, etc.
• Medical treatment: For health reasons.
• Asylum Request: For those seeking international protection.
• International protection: For refugees or holders of subsidiary protection.
• EU long-term residence permit: For those who have legally resided in Italy for at least 5 years.

Costs:

• The electronic residence permit costs €30.46, payable to the indicated postal account.
• A variable fee is added based on the length of the permit requested: 40 euros for permits up to one year, 50 euros for permits up to two years, and 100 euros for long-term permits or for managers and specialized workers.

Exceptions:

• A residence permit is not required for European Union citizens.
• Some non-EU citizens are exempt, such as citizens of Iceland, Liechtenstein, Switzerland, San Marino, and British citizens who were already permanently resident in Italy before Brexit.

1. Premessa / Introduction Il visto e il permesso di soggiorno per lavoro autonomo consentono ai cittadini non appartenenti all'Unione Europea di esercitare attività economiche, professionali o imprenditoriali in Italia. The self-employment visa and residence permit allow non-EU citizens to carry out economic, professional, or entrepreneurial activities in Italy. 

2. Quadro normativo / Legal Framework Norme principali: D.Lgs. 286/1998 (Testo Unico Immigrazione), D.P.R. 394/1999 art. 39, D.M. 11 maggio 2011, e Circolari del Ministero dell'Interno. Main regulations: Legislative Decree 286/1998 (Immigration Law), Presidential Decree 394/1999 art. 39, Ministerial Decree 11 May 2011, and Ministry of Interior circulars.

Tipologie di attività / Types of Activities Il lavoro autonomo comprende: attività professionale (es. consulente, artista, libero professionista) e attività imprenditoriale (apertura società o impresa individuale). Self-employment includes: professional activities (e.g., consultant, artist, freelancer) and entrepreneurial activities (starting a company or sole proprietorship). 4. Procedura per ottenere il visto / 

Visa Application Procedure 

1. Richiesta di nulla osta alla Camera di Commercio o all'ente competente per l'attività da svolgere. 2. Presentazione della domanda di visto al Consolato italiano nel Paese di residenza. 

3. Dimostrazione di risorse economiche adeguate, alloggio in Italia e copertura assicurativa sanitaria. 

4. Ottenimento del visto per lavoro autonomo (validità 2 anni). 

1. Request a clearance (nulla osta) from the Chamber of Commerce or competent authority. 

2. Submit the visa application to the Italian Consulate in the applicant's country. 

3. Provide proof of sufficient financial means, accommodation in Italy, and health insurance. 

4. Obtain the self-employment visa (valid for 2 years). 

5. Permesso di soggiorno per lavoro autonomo / Residence Permit Entro 8 giorni dall'ingresso in Italia, il titolare deve presentare domanda di permesso di soggiorno presso la Questura competente. Within 8 days of entry into Italy, the holder must apply for a residence permit at the local Police Headquarters (Questura). Il permesso ha durata pari al visto, è rinnovabile e consente lo svolgimento dell'attività indicata nel nulla osta. The permit has the same duration as the visa, is renewable, and allows the activity specified in the clearance. 

6. Requisiti principali / Main Requirements - Disponibilità di risorse finanziarie adeguate - Documentazione sull'attività professionale o impresa da avviare - Alloggio idoneo in Italia - Assicurazione sanitaria valida - Iscrizione a eventuali albi o registri professionali (ove richiesto) - Sufficient financial resources - Documentation on the planned professional or business activity - Suitable accommodation in Italy - Valid health insurance - Registration in professional bodies if required 

7. Rinnovo e conversione / Renewal and Conversion Il permesso può essere rinnovato dimostrando la continuità dell'attività e il reddito minimo. It can be renewed upon proof of ongoing activity and minimum income. È possibile convertire il permesso in permesso per lavoro subordinato o per motivi familiari. The permit may be converted into one for employment or family reasons. 

8. Note operative / Practical Notes Il nulla osta è rilasciato nei limiti delle quote annuali stabilite dal Decreto Flussi. The clearance is granted within the annual quotas set by the Immigration Decree (Decreto Flussi). In caso di investitori o imprenditori, è possibile richiedere il visto per investitori ai sensi dell'art. 26-bis del D.Lgs. 286/1998. Investors may apply for an Investor Visa under art. 26-bis of Legislative Decree 286/1998.
